Welcome to Simastry. These Terms of Service ("Terms") govern your use of the Simastry mobile application and website (collectively, the "Service"), operated by Simastry ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Simastry is a communication tool that uses astrological principles and artificial intelligence to provide insights about interpersonal dynamics. The Service offers:

  • Astrological sign calculation based on birth data.
  • Compatibility analyses between users and their companions.
  • AI-powered communication predictions and suggestions.
  • Personalized communication guides for relationships.
  • Daily astrological micro-learning content.

2. Important Disclaimer

Simastry is not a fortune-telling service. All predictions, insights, and compatibility analyses are pattern-based and generated using a combination of astrological principles and artificial intelligence. Our Service is designed to be a communication aid, not a definitive guide to life decisions. Specifically:

  • Predictions are probabilistic, not deterministic. They represent possible communication patterns, not guaranteed outcomes.
  • Astrological insights are based on Western tropical synastry traditions and should be treated as one lens among many for understanding relationships.
  • The Service is not a substitute for professional counseling, therapy, or relationship advice.
  • You should not make significant life decisions based solely on information from Simastry.

3. Eligibility

You must be at least 13 years of age to use Simastry. If you are between 13 and 18, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these age requirements.

4. User Responsibilities

By using Simastry, you agree to:

  • Provide accurate birth data for yourself.
  • Only enter birth data for other individuals (companions) with their knowledge and permission. You are responsible for ensuring you have appropriate consent before entering someone else's personal information.
  • Not use the Service for any unlawful, harmful, or abusive purpose.
  • Not attempt to reverse-engineer, decompile, or extract source code from the app.
  • Not use the Service to harass, stalk, or manipulate other individuals.
  • Not create multiple accounts for the purpose of circumventing subscription limits.

5. Account and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

6. Subscriptions and Payments

Simastry offers both free and premium subscription tiers:

  • Free tier: Basic astrological insights and limited features.
  • Premium subscription: Full access to all features, including predictions, unlimited companions, and advanced guides.

Subscription terms:

  • Subscriptions are billed on a recurring basis (monthly or annually) through the Apple App Store.
  • Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
  • You can manage and cancel your subscription at any time through your Apple ID account settings.
  • No refunds are provided for partial billing periods. Refund requests should be directed to Apple per their App Store policies.
  • Prices may change with reasonable notice. Any price increase will apply to your next billing cycle after the change.

7. Apple Standard EULA

Your use of the Simastry iOS app is also subject to the Apple Standard End User License Agreement (EULA). In the event of a conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA shall take precedence with respect to the licensed application.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, software, algorithms, and the overall design — are the exclusive property of Simastry and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute any part of the Service without our prior written consent.
  • Use the Simastry name, logo, or branding for any commercial purpose without authorization.
  • Reproduce or redistribute AI-generated content from the Service for commercial purposes.

9. User-Generated Content

When you submit conversation text for predictions or other content to the Service, you retain ownership of that content. By submitting content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you. We do not store conversation text beyond the immediate processing needed to generate your prediction.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
  • We are not liable for any decisions you make based on information provided by the Service.
  • In no event shall our total liability exceed the amount you paid for the Service in the 12 months preceding the claim.
  • We are not responsible for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold Simastry harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated through the app or via email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Simastry operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.
